Expanded Syringe Access Program (ESAP) Pharmacies

A new Public Health Law was mandated January 1, 2001 and became a permanent program in 2009 that authorized licensed pharmacies in good standing to register with the New York State Department of Health to sell up to 10 hypodermic needles or syringes to individuals ages 18 years or older from behind the pharmacy counter without a prescription. Registered pharmacies must participate in a program to provide safe disposal of the used hypodermic needles or syringes. The needles and syringes must be made available without a prescription, accompanied by a safety insert containing information about safe practices, and  the availability of needles or syringes without a prescription must not advertised. This public health initiative was projected to help reduce the spread of blood borne diseases such as HIV/AIDS, Hepatitis C, and Hepatitis B.
